Court Says Rahm Emanuel Not Eligible to Run for Mayor

CHICAGO — An Illinois appeals court panel has ruled that Rahm Emanuel, the former White House chief of staff, does not qualify to run for mayor of Chicago in next month’s election.

The ruling, which was announced on Monday, comes as a significant and unexpected setback for Mr. Emanuel, who has been a front-runner both in polls and in fund-raising in the race to replace Richard M. Daley, the city’s longest-serving mayor, who will retire this spring. ( Readmore... )

Court: Rahm Emanuel Can't Run For Mayor, Not Chicago Resident

An Illinois court on Monday threw Rahm Emanuel's name off the Chicago mayoral ballot, possibly ending the former White House chief of staff's bid to lead his hometown.

By a 2-to-1 vote, an appellate panel overturned two previous decisions and ruled that Emanuel is not eligible to run because he moved to Washington D.C. for two years.

There are basically two issues before the court. The first is the meaning of “residency” for the purpose of being a candidate. As I have noted before, in the law there is a concept called domicile. Basically, the concept isn’t just where you lay your head down at night, but where intend to you lay your head down permanently. And intent controls, allowing a person to claim to have a domicile in a place for years without actually being present in that jurisdiction, as long as you intend to come back and live there permanently.
